Man charged with murder after alleged fatal assault on Koondoola street two weeks ago

A 46-year-old man died three days after he was allegedly assaulted on a Koondoola street corner earlier this month. Low Kean Peng was initially charged under Section 44(1A) of the Road Transport Act 1987 for allegedly driving under the influence of alcohol and causing grievous injury to the victim.KLANG: A former event planner was granted a discharge not amounting to an acquittal (DNAA) on an earlier charge of driving under the influence of alcohol, paving the way for him to be charged with the murder of a motorcyclist who died after a road crash two months ago.Low Kean Peng, 35, is accused of murdering Zulfiqar Zamir Amirul Nizam, 26, at Persiaran Kota here about 12.30am on May 13.No plea was recorded after the charge was read before magistrate A Karthiyayini as murder cases fall under the jurisdiction of the High Court.The court fixed Oct 21 for mention.Deputy public prosecutor Salman Alfarisi Nawawi appeared for the prosecution, while Low was represented by counsel Ethan Tan.Low was initially charged on May 18 under Section 44(1A) of the Road Transport Act 1987 for allegedly driving under the influence of alcohol and causing grievous injury to Zulfiqar.According to the earlier charge, he allegedly drove with 196mg of alcohol per 100ml of blood, exceeding the legal limit of 50mg per 100ml.Zulfiqar died on May 25, after which the prosecution proceeded with the murder charge.Earlier, Tan applied for a gag order to bar members of the public and the victim's family from commenting on the case on social media until its disposal.He argued that such comments could influence witnesses and prejudice his client's right to a fair trial.However, the magistrate did not allow the application, saying it had been made in the wrong forum, and advised Tan to file a separate application later.The defence team also comprised Benjamin Tan, Savinder Singh and P Vitiya Monisha.
