La Audiencia Provincial de Málaga has annulled a court ruling that previously granted child custody to a mother in Spain. The judicial decision was based on the determination that the minor's habitual residence is actually in Tangier, Morocco.

Because the child resides habitually outside of Spain, the court concluded that Spanish tribunals lacked the proper jurisdiction over the matter under the established circumstances.
