(Bernama pic)PUTRAJAYA: Rosmah Mansor will not get a retrial in the RM1.25 billion solar hybrid project corruption case after the Federal Court dismissed her application to review its earlier decision to not disqualify the trial judge who convicted her.Today's unanimous ruling removes the final procedural hurdle before the Court of Appeal can hear Rosmah's appeal against her conviction, 10-year prison sentence and RM970 million fine in September.Chief Judge of Sabah and Sarawak Azizah Nawawi, who chaired the three-member bench, said Rosmah had failed to demonstrate any special circumstances warranting the Federal Court's intervention to set aside its earlier decision and order a rehearing.Azizah said there was no bias or coram failure in the previous Federal Court panel's dismissal of Rosmah's appeal."We find that the applicant (Rosmah) did not satisfy the threshold under Rule 137 (of the Rules of the Federal Court 1995) and the application for review is hereby dismissed," she said.Rule 137 empowers the apex court to exercise its inherent jurisdiction to prevent injustice or an abuse of process.Justices Lee Swee Seng and Ravinthran Paramaguru were also on the bench.Lawyers Jagjit Singh, Akberdin Abdul Kader, Firuz Hussein Ahmad Jamaluddin and Amer Hamzah Arshad appeared for Rosmah, the wife of former prime minister Najib Razak.Deputy public prosecutors Asnawi Abu Hanipah, Iznina Hanim Hashim, K Mangai and P Sarulatha represented the prosecution.On March 3, a Federal Court bench chaired by Justice Nordin Hassan unanimously ruled that trial judge Zaini Mazlan was not biased and that Rosmah had not suffered any miscarriage of justice.In seeking a review of that decision, Rosmah argued that the court had erred in finding that there was no real danger of bias despite the existence of two versions of the trial judgment.Had the application succeeded, she wanted a fresh Federal Court panel to rehear her appeal.On Sept 2, 2022, Zaini convicted Rosmah of soliciting RM187.5 million from former Jepak Holdings Sdn Bhd managing director Saidi Abang Samsudin, through her former aide Rizal Mansor, as an inducement to help the company secure the solar hybrid project.She was also found guilty of receiving RM5 million fr…
