Lawyers for Minority Leader Alexander Afenyo-Markin say they will pursue his GH¢15 million defamation suit against Ghana Gold Board (GoldBod) Chief Executive Officer Sammy Gyamfi despite the High Court’s decision to set aside the case. The legal team says it is awaiting the full judgment delivered on October 14, 2026, before deciding on its next steps. In a statement issued by Dehyena Chambers, the lawyers said the court registry had not made a copy of the judgment available to them as of 4:00 p.m.
They confirmed that they had their client’s instructions to pursue the matter “to its logical conclusion”. The High Court, presided over by Justice Akwasi Adjenim Boateng, set aside the suit because the writ did not sufficiently specify the statements alleged to be defamatory. – Afenyo-Markin’s lawyers The court ruled that the writ failed to meet the requirements of the High Court (Civil Procedure) Rules, 2004 (C.I. The ruling was based on a procedural issue and did not determine whether Mr Gyamfi’s comments were defamatory. In the same statement, Mr Afenyo-Markin’s lawyers accused Mr Gyamfi of relying on procedural issues rather than filing a defence to the suit.
They said Mr Gyamfi’s lawyers, Ayine & Partners, had written to the court on August 26, 2026, confirming their authority to accept service of the writ on his behalf. According to the legal team, the law firm later returned the documents to the court registry, saying their client had changed his mind. They also alleged that a subsequent attempt to serve the documents personally on Mr Gyamfi at his office was unsuccessful.
Mr Afenyo-Markin’s lawyers argued that the rules of court recognise service as complete when a lawyer undertakes in writing to accept court documents on behalf of a client. The GH¢15 million suit arose from comments Mr Gyamfi made about Mr Afenyo-Markin during a JoyNews Newsfile programme in August 2026. The Minority Leader is seeking damages over the alleged defamatory remarks.
Lawyers for Minority Leader Alexander Afenyo-Markin have accused Ghana Gold Board (GoldBod) Chief Executive Officer Sammy Gyamfi of using procedural tactics to avoid responding to their client’s GH¢15 million defamation suit. The accusation comes after the High Court in Accra set aside the suit on Wednesday, October 14, 2026, ruling that the writ of summons did not sufficiently specify the statements alleged to be defamatory. In a statement, Mr Afenyo-Markin’s legal team questioned why Mr Gyamfi had allegedly focused on procedural issues instead of filing a defence to the allegations.
