WASHINGTON — Attorneys for former U.S. Olympic canoeist David Hearn are challenging a felony destruction-of-property charge, arguing new testimony shows the Lincoln Memorial Reflecting Pool had significant damage before he allegedly entered the historic site, NBC News reported. The defense says prosecutors have not established that Hearn caused more than $1,000 in damage, the threshold required for a felony charge, according to USA TODAY.
